Halo Tech Co., Ltd. is the inventor and intellectual property rights holder of the Halo Database, Halo Database Management System, 羲和数据库, and 羲和数据库管理系统 (hereinafter referred to as Halo) software. The intellectual property rights of the Halo software, as well as all related informational content (including but not limited to text, images, audio, video, charts, interface design, layout framework, relevant data, or electronic documents), are protected under the laws and regulations of the People's Republic of China and applicable international treaties. Halo Tech Co., Ltd. holds the aforementioned intellectual property rights, except for the rights that relevant rights holders are entitled to under the law. For the avoidance of doubt, "intellectual property" as referred to in this clause means any and all rights arising from or based on the Halo software:
(a) copyrights, trademarks, trade names, domain names, goodwill associated with trademarks and trade names, designs, and patents; rights related to innovations, technical know-how, trade secrets, confidential technologies, and non-technical information;
(b) personal rights, mask work rights, rights of authorship, and rights of publication; and
(c) any other industrial property rights, proprietary rights, rights related to "intellectual property," and all renewals and extensions thereof, whether existing before or arising anywhere in the world after the effective date of this Agreement, regardless of whether such rights have been registered with relevant authorities in the applicable jurisdictions.
